Consumer Privacy Notice

This Consumer Privacy Notice explains how SimpleCheck, LLC ("SimpleCheck," "we," "us," or "our") handles personal information when you submit a SimpleCheck-hosted form, embedded widget, or related customer-facing interface (a "Consumer Page") operated on behalf of a business.

This Notice is written for consumers. It is separate from the privacy policy that applies to businesses that purchase SimpleCheck's services.

Capitalized terms not defined here have the meaning given in our Consumer Terms.

1. Our Role and Whose Privacy Policy Applies

1.1 Two kinds of information. Information handled through a Consumer Page falls into two categories, and different rules apply to each.

Business-controlled information. The information you submit through a Consumer Page, and anything generated from it, is processed for the business whose form you submitted (the "Business"). The Business is the data controller. SimpleCheck acts as a processor or service provider and handles that information only on the Business's behalf and in accordance with its instructions and our agreement with it.

SimpleCheck-controlled information. SimpleCheck separately processes limited technical and security information necessary to operate, secure, and maintain the service. For that narrow category, SimpleCheck is the controller. Section 4 describes it.

1.2 Where to direct requests. For questions or requests about how a Business uses your information, including access, correction, deletion, objection, opt-out, or communication preferences, contact the Business directly. SimpleCheck can only act on the Business's instructions and under our agreement with that Business. We will forward requests we receive to the relevant Business and assist as that agreement requires.

1.3 The Business's own notices. The Business may publish its own privacy policy and notices. Those govern your relationship with the Business. Any SimpleCheck branding on a Consumer Page is for transparency and does not replace the Business's notices.

2. Information Processed for the Business

2.1 Categories. Depending on how the Business configures its Consumer Page, we may process the following on its behalf:

Identifiers, including your name, email address, telephone number, and postal or mailing address where collected.

Submission details, meaning the answers and information you enter into the form.

Consumer report information, where you have separately authorized it. This may include a credit score indicator and available credit information obtained from a consumer reporting agency through a soft inquiry.

Estimated income information, where you have separately authorized a consumer report. This is a modeled income estimate derived from credit bureau data.

Communications, including messages, replies, message content, conversation history, and related communication metadata.

Consent records, including the specific disclosure you were shown, the date and time you consented, and the IP address from which you consented.

Technical information, including device and browser information and general location inferred from IP address.

2.2 Sources. We receive this information directly from you when you complete a Consumer Page, from the Business, from consumer reporting agencies where you have authorized a consumer report, and automatically from your device when you interact with a Consumer Page.

2.3 Purposes. We process this information on the Business's behalf to deliver your submission to the Business, to evaluate or route your inquiry as the Business has configured, to obtain a consumer report where you have authorized one, to enable the Business to communicate with you, to maintain consent and audit records required by law, and to detect and prevent fraud and abuse.

3. Consumer Reports

Where a Consumer Page presents a consumer report authorization checkbox, the disclosure shown beside that checkbox is the operative authorization. Checking it constitutes your written instruction, under the Fair Credit Reporting Act, for the Business to obtain your consumer report for the purpose stated in that disclosure.

The Business is the party obtaining and using your consumer report. SimpleCheck facilitates the request on the Business's behalf. Consumer reports are furnished by a consumer reporting agency.

Your rights regarding the information contained in a consumer report, including the right to dispute information you believe is inaccurate, are exercised with the consumer reporting agency that furnished the report. We will identify that agency on request.

Submitting a Consumer Page is not an application for credit, and no offer of credit is being made.

4. Information SimpleCheck Controls

SimpleCheck processes limited technical and security information necessary to operate, secure, and maintain the service. This includes server and application logs, security and abuse events, error diagnostics, and aggregate usage statistics that do not identify you.

We process this information for our legitimate interest in keeping the service secure, available, and functioning correctly, and to comply with legal obligations. We do not use it to build marketing profiles about you.

5. How Information Is Shared

5.1 We do not sell your information. SimpleCheck does not sell your personal information. We do not rent, trade, or otherwise disclose it to other businesses, lead buyers, lead aggregators, marketers, or data brokers. We do not share it for cross-context behavioral advertising.

5.2 Who receives it. Your information is disclosed to the Business whose Consumer Page you submitted, and to SimpleCheck, which stores and processes it on that Business's behalf.

5.3 Service providers. We use service providers to deliver the service, including hosting and infrastructure providers, communications and messaging providers, and consumer reporting agencies. They act on our documented instructions and may not use your information for their own purposes.

5.4 Legal and corporate disclosures. We may disclose information where required by law, subpoena, or legal process, to protect the rights, safety, or property of SimpleCheck, a Business, or the public, and in connection with a merger, acquisition, reorganization, or sale of assets, subject to this Notice continuing to apply.

6. Cookies and Tracking Technologies

6.1 SimpleCheck-controlled pages. Cookies and similar technologies used on SimpleCheck-controlled pages are described in our Cookie Policy at simplecheck.com/cookie-policy.

6.2 Business-configured technologies. A Business may configure its Consumer Page to include third-party tracking or similar technologies, such as advertising pixels or tags. Those technologies are controlled by the Business, not by SimpleCheck. The Business is responsible for providing the required notices and obtaining the required consents. Review the Business's privacy notice and cookie disclosures presented on or linked from the Consumer Page.

6.3 Opt-out preference signals. Where required by applicable law, we honor browser-based opt-out preference signals, including Global Privacy Control, on SimpleCheck-controlled pages. Signals directed at technologies the Business has configured are handled by the Business.

7. Your Privacy Rights

7.1 Rights. Depending on your state or country of residence, you may have the right to know what personal information is held about you and how it is used, to obtain a copy of it, to correct inaccurate information, to delete it, to opt out of its sale or sharing and of certain targeted advertising, to limit the use of sensitive personal information, and to withdraw consent you previously gave.

7.2 How to exercise them. Because most information handled through a Consumer Page is controlled by the Business, direct your request to the Business first. You may also contact us at support@simplecheck.com and we will forward your request to the relevant Business and assist as our agreement with that Business requires. For information SimpleCheck controls under Section 4, contact us directly.

7.3 Verification. We may need to verify your identity before acting on a request. We will ask only for information reasonably necessary to do so, and we will not use it for any other purpose.

7.4 Authorized agents. You may use an authorized agent to submit a request. We may ask for proof of the agent's authority and may ask you to verify your identity directly.

7.5 Response timelines. We acknowledge requests within ten (10) business days and respond within forty-five (45) days, or within the period applicable law requires. Where permitted, we may extend that period once and will tell you if we do.

7.6 Appeals. If we decline your request, you may appeal by replying to our response or writing to support@simplecheck.com with the subject line "Privacy Request Appeal." We will respond to an appeal within the period applicable law requires. If we deny your appeal, we will tell you how to contact your state attorney general or applicable supervisory authority.

7.7 No discrimination. We will not discriminate against you for exercising any privacy right.

8. Communications and Marketing

Where you consented to marketing communications on a Consumer Page, those messages are sent by or on behalf of the Business, and the Business controls them.

To stop text messages, reply STOP to any message, or HELP for assistance. To stop calls or emails, contact the Business directly. The Business is responsible for reviewing and honoring your opt-out request, including processing it manually where a channel provides no automated mechanism.

Transactional and operational messages relating to your submission are separate from marketing messages and may continue after you opt out of marketing.

9. Data Retention

We retain information processed on a Business's behalf for as long as that Business's agreement with us requires and as needed to comply with our legal obligations, resolve disputes, and enforce our agreements. Consent records and related audit information are retained for the period required by applicable law, including the Fair Credit Reporting Act and telemarketing regulations.

When a Business's agreement ends, we delete or return information as that agreement provides, subject to any legal retention requirement.

Information SimpleCheck controls under Section 4 is retained only as long as necessary for the security and operational purposes described there.

10. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls, logging, and security review of the service providers we use. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's Privacy

Consumer Pages are intended for individuals who are at least eighteen (18) years of age. We do not knowingly collect personal information from anyone under eighteen (18). If we learn that we have, we will delete it. Contact us at support@simplecheck.com if you believe a minor has submitted information.

12. International Transfers

SimpleCheck operates in the United States, and information handled through Consumer Pages is processed in the United States. If you access a Consumer Page from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your location.

13. Changes to This Notice

We may update this Notice. We will post the updated version with a revised "Last Updated" date. Where a change is material, we will provide additional notice or seek renewed consent as applicable law requires.
